These Terms of Service ("Terms") govern access to and use of the website, services and tools made available by YK DIGITAL LTDA, company number (CNPJ) 58.092.338/0001-09 ("YK Digital", "we", "us"). By accessing or using our services, you agree to these Terms.

1. Who we are and what we offer

YK Digital is a Brazilian digital marketing company. We manage paid traffic, build sales funnels and sell digital products. To support this operation, we develop and operate our own advertising campaign management tools, integrated with the official APIs of advertising platforms.

2. Use of the campaign management tools

Our management tools are restricted in use: they are intended for our own operation and for a limited group of business partners previously authorized by us. They are not offered to the general public and are not available for open sign-up.

For the tool to operate an advertising account, the account owner must grant express authorization through the platform's official authorization flow. That authorization:

• is granted directly by the account owner, on the platform itself;
• is limited to the permissions displayed at the time it is granted;
• may be revoked by the owner at any time, free of charge, in the account settings.

3. Eligibility

Use of our services is restricted to individuals aged 18 or over and to duly incorporated companies with legal capacity to contract.

4. Your responsibilities

• Provide true, complete and up-to-date information.
• Keep access credentials confidential and notify us immediately of any unauthorized use.
• Ensure you hold the necessary rights to the advertising materials, trademarks and content you provide to us.
• Comply with applicable law and with the policies of the advertising platforms used, including TikTok's advertising policies.

5. Prohibited use

You may not use our services to:

• violate any law, regulation or third-party right;
• run misleading or fraudulent content, or content that breaches advertising platform policies;
• attempt to gain unauthorized access to systems, accounts or data;
• reverse engineer, copy or resell our tools without written authorization;
• deliberately overload our infrastructure or that of integrated platforms.

6. Third-party platform integrations

Our tools integrate with third-party services such as TikTok, Meta and Google. Those services have their own terms, to which you are also subject. We are not liable for unavailability, changes, limitations or discontinuation of those platforms' APIs and features, nor for their decisions regarding approval, rejection or suspension of ads and accounts.

7. Intellectual property

The website, tools, source code, brand, layouts and materials we produce are owned by YK Digital or its licensors and are protected by applicable law. These Terms transfer no intellectual property rights. Advertising materials and data you provide remain yours.

8. Privacy

The processing of personal data is described in our Privacy Policy, which forms part of these Terms.

9. Disclaimer of warranties

Our services are provided "as is". We do not guarantee specific advertising results, sales volume, return on investment, or uninterrupted and error-free operation, since such outcomes depend on factors beyond our control, including algorithmic and commercial decisions of the advertising platforms.

10. Limitation of liability

To the maximum extent permitted by law, we shall not be liable for indirect damages, lost profits, loss of data or loss of opportunity arising from the use of or inability to use the services. Our total liability, where applicable, is limited to the amount actually paid by you to YK Digital in the 12 months preceding the event giving rise to the liability.

11. Suspension and termination

We may suspend or terminate access to our tools in the event of a breach of these Terms, a legal requirement, or a determination by the integrated platforms. You may stop using the services at any time by revoking the authorizations granted and requesting deletion of your data.

12. Changes to these Terms

We may amend these Terms at any time. The version in force is always the one published on this page, with the update date shown at the top. Continued use after a change constitutes acceptance.

13. Governing law and jurisdiction

These Terms are governed by the laws of the Federative Republic of Brazil. The courts of YK Digital's domicile shall have jurisdiction, unless otherwise required by law.
